General Terms and Conditions of Hobbygoldschmiede Oliver Kargus

1. Legal Transactions
The following provisions apply to all legal transactions unless expressly agreed otherwise in writing. By registering for the first goldsmith course, the customer acknowledges the exclusive validity of our terms and conditions. Registration takes place through payment of the course fee. Verbal agreements are only valid if confirmed by us in writing.

2. Registration
Registration for all courses is carried out exclusively through payment of the course fee for all registered persons. If payment is made on behalf of others, the payer is liable in the event of non-attendance of the registered person.

3. Cancellation
Cancellations for a goldsmith or one-day course can only be made at the registered branch. If cancellation occurs up to 6 weeks before the course begins, we will refund the paid fee minus €20 administrative costs per person. If cancellation occurs within 6 weeks before the start of the course or later, the course fee will not be refunded. In the event of illness (medical certificate required), we will issue a voucher that can be redeemed for a new course.
Wedding ring courses can only be cancelled as long as the metal has not been firmly ordered. The order is placed when the customer signs during the consultation, or in exceptional cases, via email. Once the customer has firmly ordered the metals, withdrawal from the course and the order is no longer possible.

4. Payments

a) Course fee
The course fee is to be paid upon registration, either directly in the workshop or upon receipt of an invoice. If the course fee is not received or not received on time before the start of the course, the persons will automatically be removed from the course despite registration. Participation in the desired course is then only possible if a place is available. For last-minute registrations before the start of the course, the course fee must be paid on the first day of attendance.

b) Material
Materials consumed during goldsmith and one-day courses are always settled and paid for at the office at the end of the session.
Metals firmly ordered for the wedding ring course and specially manufactured by us must be paid for no later than 6 weeks before the course. If a fixed price is agreed upon with the customer during the consultation, this price becomes binding upon signature and must be transferred within 2 weeks. Changes or cancellations are not possible.

5. Prices
The prices we quote for wedding rings are valid for acceptance by the customer on the day of consultation. The offer relates to the rings discussed in the desired alloy, width, thickness, and profile. Price offers for custom work are only binding for us if accepted immediately. Repeat and individual orders are considered new contracts, for which we reserve the right to adjust prices. Special orders and firm orders cannot be returned. Due to fluctuating precious metal prices, we also reserve a tolerance of 15% on cost estimates. Filing dust that falls into the leather during processing belongs to the customer. For this reason, we do not charge for the solder used in the courses. Weight specifications of rings therefore do not constitute guaranteed characteristics.

6. Retention of Title
Jewelry pieces made in our courses as well as all purchased semi-finished parts and stones remain our property until full payment of the purchase price and settlement of all claims arising from the business relationship. If metals and stones are processed by the customer, we continue to retain full ownership rights to the newly created item. If our products are mixed with products not belonging to us, we acquire co-ownership of the new item in proportion to the invoice amount to the value of the mixed items.

7. Complaints
Complaints must be made by the customer to us without delay. If a defect in the goods attributable to us exists, we are entitled, at our discretion, to rectify the defect or deliver a replacement. If rectification or replacement fails or is unreasonably delayed for reasons attributable to us, the buyer may choose to reduce the purchase price or rescind the contract.
The above regulation also applies in the event of incorrect or faulty delivery as well as incorrect quantity or weight specifications. Quality and quantity specifications of precious metals and stones do not constitute guaranteed characteristics.
Further claims for damages are excluded.

8. Place of Jurisdiction
The place of performance and jurisdiction, insofar as legally permissible, is exclusively Nuremberg for both parties.

9. Miscellaneous
The workshop in Münster is owner-operated (by the branch manager) and partly has its own general terms and conditions.
